Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of the FoxlyFlow website, dashboard and API (the “Service”), provided by FoxlyApps (“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms. If you use the Service for a business, you accept them on its behalf and confirm you are authorized to do so.

2. The Service

FoxlyFlow provides an API and dashboard to send and receive messages through third-party messaging platforms, starting with Meta’s WhatsApp Business Platform. The Service is currently offered as early access: features may change, and we may limit usage while we scale.

FoxlyFlow is not affiliated with, endorsed by or sponsored by Meta Platforms, Inc. WhatsApp is a trademark of Meta Platforms, Inc.

3. Accounts and API Keys

• You must be at least 18 and give accurate account information
• Keep your password, API keys and webhook secrets confidential; you are responsible for all use of them
• Tell us promptly at the support address below if you suspect unauthorized use

4. WhatsApp Messaging

When you connect a WhatsApp Business Account, you also agree to Meta’s WhatsApp Business Terms of Service, WhatsApp Business Messaging Policy and WhatsApp Commerce Policy, and you authorize us to send and receive messages on your behalf through that account.

You must:

• Obtain each recipient’s opt-in before you message them first, and honor opt-out requests promptly
• Use message templates approved by Meta for business-initiated messages
• Send only messages related to your business that recipients expect
• Pay the message charges Meta bills to your WhatsApp Business Account (separate from any FoxlyFlow fees)

Meta may restrict, suspend or ban a WhatsApp Business Account or phone number at its own discretion. We are not responsible for Meta’s decisions, but will help you understand them where we can.

5. Acceptable Use

You may not use the Service to:

• Send spam, unsolicited bulk messages, or messages to people who have not opted in
• Send content that is illegal, fraudulent, deceptive, harassing, hateful or sexually explicit
• Promote goods or services prohibited by the WhatsApp Commerce Policy (for example, drugs, weapons, gambling, adult products)
• Collect sensitive data such as full payment card numbers or passwords over WhatsApp
• Impersonate another person or business
• Probe, overload, reverse engineer or bypass the security or rate limits of the Service

We may suspend accounts or channels that break these rules, immediately where needed to protect recipients, Meta’s platform or the Service.

6. Your Data

You keep all rights to the data you send through the Service. You grant us the rights needed to process it to provide the Service, as described in our Privacy Policy. You are responsible for having a lawful basis to message your recipients and for answering their data requests, which we will help with.

7. Fees

Early access is currently free of FoxlyFlow fees. Before we introduce paid plans, we will publish prices and give you at least 30 days’ notice. Meta’s message charges always apply separately.

8. Availability and Changes

We aim to keep the Service available and secure, but do not guarantee uninterrupted operation. We may change or discontinue features; for material changes that affect your integration we will give reasonable notice where we can.

9. Termination

You can stop using the Service at any time and ask us to delete your account. We may suspend or end your access if you break these Terms, if Meta requires it, or if required by law.

10. Disclaimers

The Service is provided “as is” and “as available”. We do not guarantee that messages will be delivered, as delivery depends on Meta, recipients’ devices and networks.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses, lost profits or lost data. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim.

12. Changes to These Terms

We may update these Terms. The “Last updated” date above shows the latest version; material changes are announced by email or in the dashboard. Continued use after a change means you accept it.

13. Governing Law

These Terms are governed by the laws of India. Courts in Bhubaneswar, Odisha have exclusive jurisdiction.
